Terms & Conditions
Applicable law
The laws of England and Wales shall govern this agreement. These Terms and Conditions shall not be varied except by agreement in writing.
In the event of any conflict between these terms and conditions (including those relating to the time of payment) and those issued or submitted by the Client and in the absence of any contrary agreement in writing these Terms and Conditions shall prevail.
Photographer
Little Creative Photography is managed and run by Marzena Edwards.
Deposit
A booking form and a non-refundable booking fee of £50 are required to secure your booking, with the remaining fee due before the order is delivered to the Client.
If the booking fee is not paid within 48h of receiving an email with booking information, the session will be offered to another client.
If the Client needs to re-arrange the session, 7 days’ notice is required.
After this time a new deposit will be required to re-book. All re-arranged shoots must be agreed within 30 days.
In the event of solid rain (outdoor sessions) or illness, your sessions will be rescheduled to a new date. Sessions will not be rescheduled due to overcast weather, cold weather or wet ground.
Pricing
Little Creative Photography reserves the right to increase prices at any time. However, the Client will only pay the price quoted for their chosen package at the time of their booking, even if prices have since increased.
Prices are for one family unit of parents and their child/ children and pets. Additional family members are welcome to join an outdoor or home family session for a fee of £10 per person. This £10 per person fee is not part of your package balance and cannot be used to offset costs when upgrading to a larger package.
The Client can upgrade to a larger package after receiving access to the gallery.
The Client is not able to 'downgrade' to a smaller package after receiving the gallery.
Preparing for the photography session
Little Creative Photography provides the Client (via email or phone) with information on how to prepare for your session to get the best results. If the Client fails to carry out required preparations prior to the session or follow the offered advice (e.g. accept the suggested time for the session) Marzena Edwards will not be held responsible for any resulting reductions in quality or quantity of images supplied.
The best time for your outdoor session is in the hours following sunrise or before sunset - this is known as the Golden Hour. Winter sun is far more accommodating during the midday hours as it is low in the sky & softer than the summer sun.
Home sessions usually start at 11 am.
Mini-Sessions will usually have their own specific terms - please be sure to read the information sent to you before booking.
Proof galleries
The Client’s proof gallery will contain low resolution, unedited proof images and a selection of edited examples so that the Client can see how finished images will look (with exception of Deluxe package - where all gallery images will be fully edited).
These images must not be copied, screenshot, downloaded, printed, edited or altered in any way, under any circumstances. Doing so is a violation of copyright law. The Client's chosen images are all edited as per the edited examples and delivered via an online gallery without watermarks.
The proof gallery will remain active for 1 week for viewing and ordering. The gallery deletion date will be stated in your email. There is a £20 fee to re-create a gallery after this date. The re-created gallery will remain open for 24 hours only.
Each proof gallery will contain around 30+ images, although this may vary, and can be less, particularly for newborn sessions where much of the session is spent settling baby.
Little Creative Photography is not obligated to provide the Client with any images that are not already presented to them.
Artistic input
Little Creative Photography shall be entitled to use judgment regarding the style and artistic input in the production of pictures. This includes but is not limited to poses, props, and the number of images taken.
Digital orders
Digital Orders are delivered to you via an online gallery. The “Deluxe” package includes the USB which will contain all your digital images. The provided USB isn't intended as permanent storage.
It is solely the Client's responsibility to back up the images and make enough copies for the images to be stored safely. Little Creative Photography will not be held responsible for the loss of images due to a failure of any of the client’s devices or purchased USB or misplacement and loss of USB.
The Client must address any technical issues with the USB to Little Creative Photography within 48 hours.
Due to the nature of digital products, these cannot be exchanged after receiving them, either by download or on USB. The Client is responsible for checking the order before submitting it to Little Creative Photography.
Digital images will display slightly differently on different monitors and devices, according to factory settings, brightness, colour temperature, contrast, and various other settings.
Image format, raw files & unedited images
RAW files or unedited images will not be provided to the Client. The Client will receive finished, professionally hand-edited, high-resolution images only. The small jpeg files which make up the proofs in the proof gallery are for proof gallery purposes only. The client cannot purchase unedited images.
Prints & physical products
Pricing of prints and products is subject to change at any time without notice.
All images produced by Little Creative Photography are printed on a fully calibrated monitor, all prints will be a true reflection of the editing carried out by Little Creative Photography. Little Creative Photography will not be held responsible for variances in images caused by any other print companies other than their own and or clients viewing images on non-calibrated screens or monitors.
Colour and black & white
Digital images are provided to the Client in both colour and black & white.
Prints and products are provided in colour OR black & white. Prints & products are produced in colour as standard unless stated upfront otherwise.
Order turnaround & payment
Chosen images are individually hand-edited and delivered to the Client within 4 weeks (often sooner than that).
For all orders, payment is due in full at the time of order. No orders are made unless they are fully paid for.
Additional edits requested by the Client after viewing their photos are carried out at the discretion of Little Creative Photography, and Little Creative Photography reserves the right to charge the Client £25 per image for additional editing to cover the time involved.
Receiving your Order
The online gallery with final images is live for 6 months. It is the client's responsibility to ensure all images are downloaded to their devices and sorted safely.
Any prints ordered as part of the package are printed and delivered at the earliest possible time. It is the Client's responsibility to place the print order at the time of selecting the final images. No refunds are offered for not placing the order.
Little Creative Photography reserves the right to refund £3 to the Client for the 6x9 print in case the print order was made but the print is not delivered within 3 months of placing the print order (via email).
Image Storage
Images are stored for 12 weeks after the date of the session, if no order has been placed in this time all images will be deleted. All non-purchased images are deleted from all systems and hard drives after the Client has made the order. Purchased Images are stored for 12 months after the date of purchase.
Returns Policy
All bespoke products are non-refundable. Orders can not be canceled due to the custom nature of the products. All orders have a 24-hour cooling-off period.
Incorrectly supplied items can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error by the Client.
If a print or product has been damaged in the postal system please notify Little Creative Photography on the day that you receive it. Little Creative Photography cannot take responsibility for any damages incurred after delivery.
Copyright and Reproduction
Little Creative Photography is and shall always remain the copyright holder. No image can be copied, scanned or reproduced in any form whatsoever without the permission of Little Creative Photography.
The Client may not alter or add to or manipulate a picture by any means or reproduce a picture without written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by Little Creative Photography only when digital images are purchased and paid in full by the Client to Little Creative Photography.
The Client must obtain written permission from and compensate Little Creative Photography prior to the Client or its friends and relatives publishing or selling the photographs for profit.
Fulfillment of Obligation
Little Creative Photography shall not be liable to the Client for any failure, in whole or in part to fulfill its obligations where the failure arises as a result of an event or circumstances beyond its control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. In the unlikely event of total photographic failure or cancellation of the contract by Marzena Edwards liability shall be limited to a full refund of all money paid.
Special requests are not binding instructions although every effort is made to comply with the Client’s wishes.
Limitations of liability
Marzena Edwards takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Marzena Edwards’ control, Marzena Edwards’ liability is limited to the return of all payments received for the photography package.
Privacy
Little Creative Photography may use your photographs to promote and advertise Little Creative Photography business, including:

in the printed publications, presentations, promotional materials (including leaflets, brochures, stickers, bookmarks, posters, fact sheets, calendars);

on the website and other digital advertising of the provided services; and
-
in social media forums such as Instagram, Pinterest, and Facebook.

Exhibitions
Requests for specific photographs to be used by Marzena Edwards may be requested at a future time. The Client grants Marzena Edwards permission to display selected images resulting from this assignment as an example of Little Creative's photography work and for entrance into photographic competitions and release all claims to profits that may arise from the use of images.
Pets
Pets can join the home photography session or the Client can bring them along to the outdoor session. Due to limited space, pets may not be able to join the studio session. Please enquire before booking.
Please bear in mind that all animals remain the sole responsibility of the Client at all times.
Unhappy Children & Follow-up Shoots
Due to the willingness of subjects, it may not be possible to capture all the pictures requested or images to the Client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Little Creative Photography may not be able to capture any, or all the images the Client may have requested or expected.
In the rare event that not enough images can be taken to fulfill your package, a follow-up session will be scheduled at no extra cost. If the Client decides on a follow-up session, no images can be ordered from the original gallery until the follow-up session has taken place and has been added to the original gallery. The follow-up session will take place within 2 weeks of the original session. A baby or child not smiling, or not smiling in the way the Client would like them to, is not a valid reason for a follow-up session.
The Client may need to participate in the session even if they were just intending to have photographs of their little one/s in a situation when babies want to be held by mum or dad or younger children are shy.
Health & safety
Marzena Edwards cannot be held accountable for any trips, falls, injuries or bites that occur during the home, studio or outdoor sessions.
The Client is responsible for the children’s safety during the photoshoot. The Client must, therefore, ensure that a responsible adult other than Marzena Edwards is present at all times to supervise the children.
Gift Vouchers
Gift Vouchers are valid from 1 year from date of issue unless otherwise specified and are non-refundable. Vouchers are not redeemable for cash or to be used in conjunction with any other offer. Gift Vouchers are delivered in person or sent by recorded 1st class delivery. Gift Voucher Design may change at any time.
In the event of a gift voucher recipient not showing up to their booked session, £50 will be deducted from the gift voucher value as damages.
Photography and Video By Client’s Camera
Cameras, mobile phone cameras, and camcorders are not permitted during any session to take photos or video of the set-up and/or the child on their own without permission from Little Creative Photography.
Any Problems?
My Clients' satisfaction is of the utmost importance to me. As a small business, I rely on help and recommendations from my clients. Should you have any problems following your session, please contact me to arrange a call to discuss your concerns or any issues.
In an unlikely event that no agreement can be reached between the Client and Little Creative Photography, I reserve the right to request the return of all images and prints from the session (at the Client's cost) and deletion of any reference to Little Creative Photography online (e.g. Facebook, Instagram, Google review, etc.) for a full refund.
Additional Terms & Conditions for Beginners Training Course for Parents
1. A £20 deposit is required to secure your place on the course, and the remaining £20 is due 2 weeks before the course date. If payment is not made on time, your place on the course may be given to another attendee. If you cancel more than 2 weeks before the course date, you will not be liable to pay the £60 but your deposit will be retained. Unfortunately, if you cancel within 2 weeks of the course date the full amount will be retained unless a replacement can be found. You are welcome to sell your place if necessary.
2. The course materials remain the property of Little Creative Photography and cannot be reproduced or shared without permission
3. This course is NOT for professional photographers, or for people planning to start a photography business in the future. Attendees must agree not to run any Beginners Photography training courses, in any way similar to Little Creative Photography's Course within a 2 year period.
IF ANY PROVISION OF THIS AGREEMENT IS HELD TO BE INVALID OR UNENFORCEABLE UNDER THE LAW, THE VALIDITY OF THIS AGREEMENT AS A WHOLE SHALL NOT BE AFFECTED, AND THE OTHER PROVISIONS OF THE AGREEMENT SHALL REMAIN IN FULL FORCE AND EFFECT.
